'Detailed' book of evidence served in Waterford dangerous driving case

The case of an American motorist charged with dangerous driving causing death is ongoing.
John Fitzgibbon (67), with an address given as New York, US, was charged in July 2025 with dangerous driving causing death during a special District Court sitting.
On July 9 Mr Fitzgibbon was driving a vehicle near the Cullencastle area of Monvoy, Tramore, when the vehicle collided with a motorcycle being driven by 55-year-old Tramore man Michael O’Sullivan. Mr O’Sullivan passed away on the morning of July 11 at University Hospital Waterford (UHW).
The accused was remanded on bail. Family of the defendant acted as independent sureties while proceedings are ongoing, thus allowing him to return to the States.
Mr Fitzgibbon is being represented by Greg Murphy BL, under the instruction of solicitor John Quinn.
In December 2025, the book of evidence was served and the case was moved to the Circuit Court.
Last week, the defence counsel told Judge Eugene O'Kelly that Mr Fitzgibbon would be present for a 'realistic trial date', stating: "I'm just conscious that he lives in USA."
State Prosecutor Niall Storan BL informed Judge O'Kelly: "This is a very involved case. There is a very detailed book of evidence which may have more details than you'd expect."
Mr Storan said that disclosure had not been made yet.

The family of Mr O'Sullivan were present in court for the hearing. Judge O'Kelly addressed them: "I appreciate you have been here all day, no member of a family should be left waiting in court."
Judge O'Kelly directed that on the next hearing date, the matter would be dealt with earlier in the day. The case will be re-visited on April 14.
