Gardaí found stolen cheques at a man’s home while executing a drugs warrant, Waterford District Court was told.

Davin Marshall (20) of 22 Mount Sion Crescent, Waterford, was charged with two counts of being in possession of stolen property and two counts of possession of drugs for personal use on August 8 and October 13, 2023.

The court was told that gardaí executed a warrant at the defendant’s home and found €500 worth of drugs and two cheques which belonged to an individual who’s home had been broken into.

Acting for the defendant solicitor Ken Cunningham pointed out that his client was not charged with stealing the cheques and they were neither signed nor lodged.

He said his client had no previous convictions and the amount of drugs seized were of a “nominal value”. 

Mr Cunningham said his client is no longer associated with the peers involved with drugs.

Judge Kevin Staunton noted that the defendant was a young man with no criminal record.

He put the matter back 12 months to give the defendant a chance not to come to any more garda attention.

If he does not, the matter will be struck out.
