Waterford woman to avoid conviction for theft if she reimburses shop and makes a donation

A woman has been given a chance to avoid a conviction for theft if she reimburses the shop and makes a donation to the court poor box.
Laila McCabe (22), O’Connell Street, Waterford, was before Judge John Cheatle at Waterford District Court, charged with the theft of €117 worth of jewellery and lingerie from TK Maxx, Poleberry, on March 24, 2025.
The court was told that the defendant had three previous convictions but none for theft.
Acting for the defendant, solicitor Ken Cunningham told the court that the offence was committed with another person.
He said his client is working in hospitality.
Sergeant John Phelan told the court that the items were not recovered and TK Maxx remain at a loss.
Judge Cheatle said if the store was reimbursed, he would be inclined to strike the matter out.
He ordered the defendant to pay the €117 to TK Maxx by October 14 and to make a €50 donation to the court poor box.
