An American man has been sent forward to Waterford Circuit Court in relation to a fatal road traffic incident in Tramore during the summer.

John Fitzgibbon (67), with an address given as New York, US, is charged with dangerous driving causing death in the incident which occurred in July.

Sergeant Michael Hickey told Waterford District Court that the book of evidence had been served and DPP consent to send the defendant forward to the Circuit Court had been received on September 19.

Judge Cephas Power gave the defendant an alibi warning, which means that if Mr Fitzgibbon intends to rely on alibi evidence, he must inform the state within 14 days.

The judge remanded the defendant on continuing bail to the current sittings of Waterford Circuit Court.

The solicitor acting for the defendant asked the court to excuse her client and allow him to return to the states until he is required in court.

Judge Power said that, as he had sent the defendant forward to the higher court, he was not able to decide that anymore.

He advised the counsel for the defendant to make the application to the Circuit Court.

The Circuit Court put the matter back to January 13, 2026.
