A 24-year-old man falsely presented his sister’s insurance disc as his own to Gardaí.

Theo Aaron Cavanagh was convicted of presenting a false document to Gardai contrary to Section 28 of the Theft and Fraud Offences Act.

Cavanagh, of 73 Marymount, Ferrybank, appeared at Waterford District Court of Appeals before Judge Eugene O’Kelly. He was appealing an eight-month custodial sentence that was handed down by Waterford District Court.

The Court heard that on November 13, 2024, the defendant presented the disc to Gardaí. The on-duty Sergeant verified the disc with the relevant insurance company and found that the disc belonged to the defendant’s sister, who was unaware of the deception. Cavanagh accepted that he had made a "very immature and very stupid mistake". 

According to State Solicitor Frank Hutchinson, the defendant had two previous convictions, including driving with no insurance.

Judge O’Kelly commented: “It is a shock that this young person had already been caught driving with no insurance.” The custodial sentence was suspended for a period of 18 months.
