Judge Staunton fined the man €500 and gave him four months to pay.

A man has been fined €500 for an incident that involved a drunken scuffle, which was broken up by gardaí.

Brian O’Neill (20), of 72 Meadowbank, Cork Road, Waterford, pleaded guilty to being intoxicated in a public place and threatening, abusive or insulting behaviour, contrary to Sections 4 and 6 of the Criminal Justice (Public Order) Act 1994 at a sitting of Waterford District Court before Judge Kevin Staunton.

The court was told that gardaí separated two males in a scuffle on John Street in Waterford.

One of the males, the defendant, “did not take being asked to leave well” and had to be arrested.

The defendant had two previous convictions for being intoxicated in a public place and threatening, abusive or insulting behaviour.

Acting for the defendant, solicitor Ken Cunningham said alcohol “underpins” his client’s problems, but that he was about to take up work.

Judge Staunton said he hoped the defendant continued to work and that “it should be clear to him that he has an alcohol problem”.

“He needs to sort himself out; nobody will do that for him,” said Judge Staunton.

Judge Staunton fined the man €500 and gave him four months to pay for the charge of threatening, abusive or insulting behaviour and took the public intoxication matter into consideration.
