A housing development which was the subject of appeal in county Waterford has been granted permission to commence by An Bord Pleanala.

The subject site is located at the rear of Kilminion Close and Kilminion Park housing estates, Ballinroad.

The proposal comprises the construction of 40 residential units, made up of 4 four-bed detached units, 12 three-bed semi-detached units, 10 four-bed semi-detached units and 14 two-bed terraced units.

Seventy-three parking spaces are also part of the submitted plans.

On the August 21, 2024, Waterford City and Council granted permission for the proposed development, following the submission of further information from the applicant.

A third party appeal was submitted against this decision.

The grounds of appeal outline that the existing road (L3012) was unsuitable for additional traffic, with footpath widths also being inadequate.

It was also noted that the proposed level differences of 1.0 to 1.2 metres will result in unacceptable impacts of overlooking and loss of privacy to rear private amenity spaces.

Appeals said that the services referenced in the social infrastructure audit are no longer in existence and schools/childcare are not available in the locality, which will lead to additional trips. Public transport is also irregular and would not support a new development.

An Bord Pleanala decided to grant permission to the development this month, saying that it is ‘in accordance with the proper planning and sustainable development of the area’.

The development was approved subject to 18 conditions.
