The High Court has refused bail in the case of a man charged with the assault of a man in his 70s, who later died in Waterford.
David Norris (35), of Assumption Terrace, Rosbercon, New Ross, Co. Wexford, appeared by video link before Judge Kevin Staunton at Waterford District Court on Tuesday, September 16, and is charged with assault causing harm to Pat Fitzgerald.
Acting for the defendant, solicitor Ken Cunningham informed the court of the High Court decision and asked the state to provide a copy of the pathology report.
Acting for the state, Sergeant John Phelan told the court that the file went to the DPP on Monday, and asked that the matter be put back two weeks. He said the pathology report is not yet available.
Judge Staunton remanded the defendant in continuing custody and put the matter back to September 25 for DPP instructions.
