Gardaí witnessed 'visible injuries' on woman's face
The matter was heard in camera.
Gardaí called to a domestic disturbance in April this year reported seeing 'visible injuries' to a woman's face.
Sergeant Michael Hickey told Judge Kevin Staunton that a woman had called Gardaí after her husband allegedly pinned her to a bed and hit her three times in her face with an open hand. The man was charged with assault contrary to Section 3 of the Non-Fatal Offences Against the Person Act.
Solicitor Hilary Delahunty said that 'no injuries' were reported, but Sgt Hickey interjected: "Injuries were witnessed by Garda."
Mr. Delahunty stated that the woman did not make a statement to Gardaí, to which Judge Staunton responded: "She called the guards and said she was attacked."
Mr. Delahunty repeated that there was no statement made. Judge Staunton replied: "No statement yet."
The matter will be heard again in December.
