'Expert' report sought for Waterford fatal crash
The defendant resides in the US.
The case into the death of Tramore grandfather Michael O'Sullivan came before Waterford Circuit Court last week.
John Fitzgibbon (68) was charged with dangerous driving causing death in July 2025, after his car collided with a motorcycle driven by the victim.
On July 9, Mr Fitzgibbon was driving a vehicle near the Cullencastle area of Monvoy, Tramore, when the vehicle collided with a motorcycle being driven by 55-year-old Tramore man Michael O’Sullivan.
Mr O'Sullivan died at University Hospital Waterford (UHW) on July 11.
On that same day, Fitzgibbon was charged and received bail with family members acting as independent sureties. He has since returned to his home in the United States.
Last week, legal counsel for Fitzgibbon asked to produce an "expert engineering report" to the State in his defence. State prosecutor Niall Storan BL informed the court that the deceased's family were present in court and wished to see the case proceed.
Judge O'Kelly accepted the request of the counsel, but expressed "disquiet" over the delay for the family of Mr. O'Sullivan.
The matter will be revisited on December 3.
